Intersection collision / bilateral rotator cuff tears

TRACTOR-TRAILER/MOTOR VEHICLE
Previous: TMJ Problems Alleged to be "Serious Injury"                 Next:   Head-on Collision/Fractured Neck

The Plaintiff was operating a vehicle and was struck broadside by the Defendant, who entered the intersection despite a stop sign, forcing the Plaintiff’s vehicle across the road and into a parking lot where she struck three parked cars and a utility pole. The Plaintiff claimed bilateral rotator cuff tears in addition to neck and back injuries as a result of the accident. She claimed the back condition had permanently impaired her to the extent that she needed a walker to ambulate. At trial, the Plaintiff offered evidence of three orthopedic surgeries and $88,000 in medical specials. The Defendant admitted negligence, but contested causation of the claimed injuries. A defense verdict was entered.
