The Plaintiff was a limited tort selector. The Defendant rear-ended the Plaintiff and she claimed a TMJ injury. One surgery was completed at the time of trial with a future surgery scheduled. The jury found that the Defendant was negligent in causing the accident but that the accident was not a substantial factor in bringing about the Plaintiff 's injuries which the Defendant argued were pre-existing.
